حق تقرير المصير في الشريعة الإسلامية والقانون الدولي

Résumé: "عنوان المذكرة موسوم بــ: "" حق تقرير المصير في الشريعة الإسلامية والقانون الدولي""، وإشكاليته الرئيسية التي حاولت الإجابة عنها تتمحور حول ما مدى شرعية حق تقرير المصير في الشريعة الإسلامية والقانون الدولي، وقد جاء الموضوع في ثلاثة مباحث خصص أولها لماهية تقرير المصير وذلك من خلال تعريفاته ومراحل تطوره التاريخي ومصادره في الشريعة الإسلامية والمواثيق الدولية العالمية والإقليمية، وجعل المبحث الثاني للأسس الشرعية والطبيعة القانونية لحق تقرير المصير، والأساس الشرعي الذي يقوم عليه، والضوابط الشرعية له، وجاء المبحث الثالث لأساليب تحقيق حق تقرير المصير، وذلك من خلال الوسيلة السلمية وهي الاستفتاء والوسيلة الغير سلمية والمتمثلة في استخدام القوة لنيل هذا الحق، وتعرض المبحث الثالث كذلك للمسؤولية الدولية المترتبة عن انتهاك حق تقرير المصير. ووصل البحث إلى أن حق تقرير المصير هو مبدأ وحق قانوني وقاعدة دولية آمرة لا يجوز مخالفتها ولا حتى الاتفاق على مخالفتها. " The study was entitled "The Right to Self-Determination in Islamic Law and International Law". The main problem of it was to discuss the legitimacy of self-determination in Islamic law and international law, Its definitions ,stages of historical development and its sources in Islamic law and international and regional international conventions, and the second section was made by the foundations of legitimacy and the legal nature of the right of self-determination, and the basis of legitimacy on which it, and the controls of legitimacy, and the third section of methods to achieve the right to report Through the peaceful means of referendum and the non-peaceful means of using force to achieve this right. The third section presented the international responsibility resulting from the violation of the right to self-determination
