دور القضاء الدستوري في حماية الحقوق والحريات في ليبيا

Résumé: ملخص الدراسة يهدف هذا البحث إلى دراسة دور القضاء الدستوري في حماية الحقوق والحريات في ليبيا، من خلال تحليل الإطار القانوني المنظم له، والآليات التي يعتمدها لممارسة الرقابة الدستورية، والتحديات التي تواجهه، مع تقديم مقترحات لتعزيز فعاليته. كما قد تناول البحث في المبحث الاول الأسس النظرية للقضاء الدستوري، حيث تم توضيح مفهومه وتطوره في ليبيا عبر المراحل الدستورية المختلفة، إضافة إلى القواعد القانونية المنظمة له والهيئات المختصة بالفصل في النزاعات الدستورية. في المبحث الثاني، تم التركيز على دور القضاء الدستوري في حماية الحقوق والحريات، من خلال طرق الرقابة على دستورية القوانين والتصدي للتشريعات المخالفة لحقوق الإنسان، مع عرض أمثلة لقضايا دستورية بارزة في ليبيا. أما المبحث الثالث، فقد ناقش التحديات التي تعيق فاعلية القضاء الدستوري، مثل غياب الاستقرار السياسي والقصور التشريعي وضعف الثقافة الدستورية، كما تم تقديم مقترحات لتعزيز دوره، مثل إصلاح النظام القانوني ونشر الوعي الدستوري والاستفادة من التجارب الدولية في هذا المجال. لقد خلص البحث إلى أن القضاء الدستوري الليبي يحتاج إلى إصلاحات جوهرية لضمان استقلاله وتعزيز دوره في حماية الحقوق والحريات، حيث يعتبر إنشاء محكمة دستورية مستقلة وتحديث القوانين المنظمة لعملها وتوسيع نطاق الوعي الدستوري بين المواطنين، من أهم العوامل التي ستُسهم في ترسيخ دولة القانون وتحقيق العدالة الدستورية في ليبيا. Abstract of the study The aim of this study is to examine the role of the constitutional judiciary in the protection of rights and freedoms in Libya by analyzing its legal framework, the mechanisms used for constitutional review, the challenges it faces, and suggestions for improving its effectiveness. The first chapter examines the theoretical foundations of constitutional jurisdiction, its development in Libya, the legal principles governing its functioning, and the judicial institutions responsible for constitutional disputes. Chapter 2 focuses on the role of the constitutional judiciary in protecting rights and freedoms through constitutional review mechanisms, addressing laws that violate human rights, and presenting important constitutional jurisprudence in Libya. Chapter 3 analyzed the main challenges hindering the effectiveness of the constitutional judiciary, such as political instability, inadequate legislation and weak constitutional awareness. It then proposed solutions to strengthen its role, such as legal reforms, public awareness campaigns and the adoption of international best practices. The study concluded that the Libyan constitutional judiciary needs fundamental reform to ensure its independence and strengthen its role in protecting rights and freedoms. Establishing an independent constitutional court, modernizing relevant laws, and raising constitutional awareness among citizens are necessary steps to uphold the rule of law and ensure constitutional justice in Libya.
