أثر القواعد الفقهية في تفعيل مقاصد الشريعة

Résumé: الملخص: إن تفعيل مقاصد الشريعة هو إخراجها من حيز التنظير إلى حيز الواقع العملي، واستحضارها عند معالجة القضايا التي تنزل بالمكلفين في جميع مجالات الحياة؛ وهذا باعتبارها من الأدلة الكفيلة بإبقاء الفقه الإسلامي مسايرًا لكل عصر، خادمًا للمستجدات والحوادث. كما أن محاولة ربط تفعيلها بالعلوم الإسلامية الأخرى، كفيل بالجمع بين بعديها النظري والعملي. ومن العلوم الناهضة بتفعيلها علم القواعد الفقهية؛ إذ أن القواعد تطبيق عملي لمقاصد الشريعة، بل يمكن اعتبارها وسيلة لإثبات هذه المقاصد. Abstract: The activation of the sharia objectives: is to bring it out of the theoretical space to the practical world, and also evoked it during the treatment of the questions which fall to the responsibles in all the fields of the life, and that as as one of the guides to keep Islamic jurisprudence in compliance with all times, in order to serve developments and incidents. Also, an attempt to link its activation with other Islamic sciences is enough to combine its theoretical and practical dimensions. Among the sciences which favor its activation: the science of the rules of jurisprudence; because these rules are a practical application of the objectives of Islamic law, they can rather be seen as a means of proving those objectives.
