أهلية الجنين والحقوق المترتبة عليها: دراسة مقارنة بين الفقه الإسلامي والقانون الجزائري

Résumé: ملخص: لقد سما الإسلام بالإنسان، فاعترف بإنسانيته، وميّزه بالعقل والتمييز، وجعل الأهلية من أهم خصائصه. والأهلية عبارة عن قابلية وجدارة، وهذه القابلية والجدارة إمّا أن تكون متعلّقة بثبوت الحقوق لصالح الشّخص أو ثبوتها عليه لصالح حقّ الغير، وإمّا أن تكون متعلّقة بصحّة صدور التّصرفات منه. ولقد قسّم الأصوليون الأحناف – وتبعهم في ذلك فقهاء القانون الوضعي- حياة الإنسان بحسب تطور أهليته إلى مراحل أربع، وهي : مرحلة الحمل (الاجتنان) ، ومرحلة ما دون التّمييز، ومرحلة التّمييز، ومرحلة البلوغ. وسوف تقتصر دراستنا في هذا البحث على بيان وإبراز الأهلية والحقوق المترتبة عليها في مرحلة الاجتنان، هذه المرحلة الحرجة من حياة الإنسان، والتي أولت لها الشريعة الإسلامية والقوانين الوضعية عناية خاصة؛ فالجنين يعدّ جزءا من أمّه من جهة، ويعدّ منفردا بالحياة من جهة أخرى؛ لذلك وقف الفقهاء معه موقفا خاصا، وأعطوه أحكاما خاصة. Abstract: Islam has characterized man, recognized his humanity, and characterized by reason and discrimination, and make eligibility one of its most important characteristics. Eligibility is aptitude and merit, and this competence and merit either be related to the establishment of rights in favor of the person or prove it in favor of the right of others, or be related to the validity of the conduct of it. The fundamentalist sects - followed by the jurists of positive law - have divided human life according to the development of its eligibility to four stages: the stage of conception, the stage without discrimination, the stage of discrimination, and adulthood. In this study, our study will be limited to showing the importance and rights of the fetus during the stage of the fetus. This is the critical stage in human life, in which Islamic law and special laws give special attention to the fetus. The fetus is part of its mother on the one hand, The jurists stood with him in a special position and gave him special provisions.
