دور النظام العام في تحقيق العدالة العقدية

Résumé: تناول موضوع "أثر النظام العام على العدالة العقدية" دراسة دور القانون والنظام العام في تحقيق العدالة في العقود. فقد تبين أن النظام العام يلعب دورًا حاسمًا في تحقيق العدالة العقدية، إذ يتضمن مبادئ وقواعد أساسية يجب الالتزام بها في العقود لتحقيق المساواة بين الأطراف والحفاظ على حقوق كل طرف في العقد. وعلى هذا الأساس، فإن النظام العام يحدد الإطار القانوني الذي يجب احترامه في صياغة العقود وتنفيذها، ويؤدي بذلك إلى ضمان تحقيق العدالة العقدية وتفادي الظلم أو التحيز الذي قد ينتج عن عدم احترامه. The topic "The Impact of Public Order on Contractual Justice" dealt with the study of the role of law and public order in achieving justice in contracts. It has been shown that public order plays a decisive role in achieving contractual justice, as it includes basic principles and rules that must be adhered to in contracts in order to achieve equality between the parties and preserve the rights of each party to the contract. On this basis, the public order defines the legal framework that must be respected in drafting and implementing contracts, and thus leads to ensuring the achievement of contractual justice and avoiding injustice or prejudice that may result from disrespecting it.
