القيود القانونية المفروضة على عملية الاستثمار الأجنبي في القطاع المصرفي The Legal Restrictions On Foreign Investment In The Banking Sector

Résumé: تسعى المنظومة القانونية المصرفية في الجزائر إلى جذب أكبر عدد من المستثمرين الأجانب ، وهذا من أجل دعم الاقتصاد الوطني ومواكبة التطورات الاقتصادية، ولقد خلصت نتائج الدراسة على أنه رغم وجود عدة ضمانات قانونية في قانون الاستثمار وقانون النقد والقرض ممنوحة للمستثمرين الأجانب في إطار ممارستهم للنشاط البنكي داخل الإقليم الوطني، إلا أنه مقابل ذلك توجد مجموعة من القيود المفروضة عليهم خلال جميع مراحل مشروع الاستثمار المصرفي، وهذا من شأنه أن ينعكس سلبا على تطور الاستثمار الأجنبي في الجزائر. The legal banking system in Algeria aims to attract the largest number of foreign investors. This is to support the national economy and keep pace with economic developments. Although the Investment as well as Money and Credit laws give several legal guarantees to foreign investors in the context of their practice of banking activity within the national territory, there is a corresponding set of restrictions imposed on them during all stages of the investment banking project, Which has negative impact on the foreign Direct Investment in Algeria.
