شروط اكتساب صفة المرقي العقاري Conditions For Acquiring The Status Of A Real Estate Promoter

Résumé: مـلخـص: تهدف هذه الدراسة حول موضوع النظام القانوني للمرقي العقاري الذي يعتبر العنصر الأساسي في نشاط الترقية العقارية والركيزة الأساسية، حيث حاولت الدراسة تبيان كيفية تنظيم المشرع الجزائري والمشرع التونسي لمهنة الترقية العقارية بداية من التسمية ووصولا إلى أهم الشروط الواجب توفرها في المرقي العقاري. الذي اهتم بوضع قيود وضوابط وأسس لممارسة نشاط الترقية العقارية، كما ألزم المرقي العقاري في الحصول على الاعتماد والقيد في السجل التجاري والتسجيل في صندوق الضمان والكفالة المتبادلة. الكلمات المفتاحية: مرقي عقاري- الاعتماد- أنواع المرقي العقاري،البعث العقاري. Abstract Our research study aims to investigate the legal system of the real estate promotion as being the main feature of the practice of the real estate promotion activity. Hence, we tried to explore how the Algerian and the Tunisian legislator organize the profession of the real estate promotion, starting from its designation up to the most important conditions that must be met in the real estate promoter, by setting restrictions and foundations for practicing the real estate promotion activity and obliging the real estate promoter to obtain accreditation and registration in the trade register and in the Mutual Guarantee and Warranty Fund.
