التجارب النووية الفرنسية في الجزائر و آثارها على البيئة

Résumé: ملخص : يعد النزاع المسلح الذي خاضته الجزائر ضذ فرنسا من قبيل النزاعات المسلحة الدولية والتي تنطبق عليها أحكام القانون الدولي الإنساني و هذا بمقتضى أحكام البروتوكول الإضافي الأول لسنة 1977 و المنظم لسير النزاعات المسلحة الدولية. إذ تعتبر فرنسا مسؤولة دوليا عن جميع الجرائم التي قامت بها على الأراضي الجزائرية وبالأخص تجاربها النووية التي قامت بها في الصحراء الجزائرية في عين إيكر و رقان و التي خلفت كارثة بيئية إنعكست آثارها على الطبيعة و الإنسان. بحيث تعتبر تلك التصرفات جرائم حرب معاقب عليها بمقتضي جميع القوانيين والأعراف الدولية المنظمة لسير النزاعات المسلحة و التي تستوجب مطالبة الدولة الجزائرية من فرنسا بتعويضها و تعويض الأشخاص المتضررين عن الأضرار التي لحقت بهم و كذلك بالبيئة الطبيعية من آثار تلك التجارب النووية. : Abstract The armed conflict that Algeria fought against France is considered an international armed conflict to which the provisions of international humanitarian law apply in accordance with the provisions of additional protocol of 1977 regulating the conduct of international armed conflicts .France is considerd internationally responsible for all the crimes it has committed on the territory Algeria, especially its nuclear tests carried out in Ain Eker and . Reggane, which left an environmental disaster that reflected its effects on nature and man These actions are considered war crimes punishable under all international laws and norms regulating the conduct of armed conflicts, which require the Algerian state to demand compensation from France and to compensate the affected persons for the damages they have suffered, as well as the nature .the effects of those experiences
