خُصوصية تضامن الشُركاء في بعض الشركات التجارية

Résumé: تَقتضي مُزاولة النشاط التجاري دُخول التاجر في علاقات قانونية عديدة ومُتداخلة، كما تَمتاز المُعاملات بين التجار بالسرعة والائتمان، مِمّا يجعل كل تاجر في حالة مَديُونِية شِبه دائمة، لذلك كان من الضروري إِيجاد سُبل تضمن سَداد الدين التجاري قبل إِعلان التوقف عن الدفع وتفعيل نظام الإِفلاس، خاصة وأَنَّ مُعظم العمليات التجارية تكون مقرونة بِأَجل، وأَنَّ التُجار غالباً لا يطلبون تأمينات عينية لتأمين العمليات التجارية المتعلقة بتجارتهم. ونظراً لأَهمية التأمين التجاري الغَير مضمون غالباً برهن أَو امتياز، كان لزاماً حمايته بمبدأ الضمان العام، والتضامُن المُفترض عموماً، والمُكرس أَحياناً بصريح النص بين الشُركاء في بعض الشركات، وصولاً إِلى نظام الإِفلاس. Summary: requires the course of business activity enter the merchant in many legal relationships and interdependent, and feature transactions between traders as quickly as credit, making each trader in the case of semi-permanent indebtedness, so it was necessary to find ways to ensure repayment of the debt before the declaration of cessation of payments and activating the bankruptcy system, especially that most business operations be coupled with time-bound, and traders often do not ask for in-kind insurance to secure commercial operations relating to ply their trade. In view of the importance of commercial insurance others content often proved or concession, it was imperative to protect the principle of public security, solidarity and generally assumed, sometimes devoted expressly between partners in some companies, to the bankruptcy.
