المركز القانوني للاجئ المناخ في القانون الدولي لحقوق الانسان

Résumé: لاجي المناخ مفهوم جديد موجود في الواقع و في تزايد مستمر بسبب آثار تغير المناخ الذي ينتهك حقوق الإنسان ويمنع التمتع الكامل بها، لهذا سلطنا الضوء في هذه الورقة البحثية على المركز القانوني للاجئ المناخ في قانون حقوق الإنسان الدولي لمعرفة مكانته ونوع الحماية التي يتمتع بها في ظل هذا القانون نظرا لكونه لا يتمتع بالحماية الدولية التي يتمتع بها اللاجئ السياسي. ولمعرفة مركزه القانوني طرحنا الإشكالية التالية: ما هو المركز القانوني "للاجئ المناخ" في القانون الدولي لحقوق الإنسان؟ بهدف التعرف على مدى كفاية أحكام القانون الدولي لحقوق الإنسان في تلبية احتياجات هذه الفئة الهشة وحماية حقوقهم وضمان التمتع بها دون تمييز في بلد الملجأ. Climate refugee is a new concept that exists in reality and is constantly increasing due to the effects of climate change that violates human rights and prevents the full enjoyment of them. For this reason, we have highlighted in this research paper the legal status of climate refugees in international human rights law to know their status and the type of protection they enjoy under This law is due to the fact that it does not enjoy the international protection that a political refugee enjoys. In order to know his legal status, we raised the following problem: What is the legal status of a “climate refugee” in international human rights law? With the aim of identifying the adequacy of the provisions of international human rights law to meet the needs of this vulnerable group, protect their rights and ensure their enjoyment without discrimination in the country of refuge.
