الرقابة الدستورية على المعاهدات الدولية دراسة مقارنة بين النظام الدستوري الجزائري و المصري

Résumé: تعتبر الرقابة على المعاهدات الدولية من اهم الموضوعات وذلك لما لها من اهمية بالغة ودور كبير في تنمية التعاون بين الدول و الحفاظ على السلم و الامن الدوليين ،كما تعتبر اهم مصدر للقانون الدولي العام،وظل الربط بين القانون الدولي و القانون الداخلي امر في غاية الصعوبة حيث نشات بموجبه اتجاهات واراء فقهية لا تعد و لا تحصى محاولين جميعا ايجاد احسن الحلول و افضلها. ويكتسي موضوع الرقابة على دستورية المعاهدات الدولية اهمية بالغة كونه يتعلق بحماية مبدا سيادة الدستور امام التشريعات الدولية تماشيا مع مقتضيات مبدا المشروعية، وتختلف الرقابة على المعاهدات الدولية من دولة الى اخرى، فمنها من انتهجت اسلوب الرقابة القضائية مثل مصر و البعض الاخر انتهج اسلوب الرقابة السياسة مثل الجزائر. الكلمات المفتاحية :المعاهدات الدولية، الرقابة ،المجلس الدستوري،المحكمة الدستورية العليا. The monitoring of international treaties is one of the most important issues because of its great importance and a great role in the development of cooperation between countries and the maintenance of international peace and security. It is also the most important source of international public law. It arose in accordance with countless doctrinal ways and opinions, all trying to find the best solutions . The issue of monitoring the constitutionality of international treaties is of great importance as it relates to the protection of the principle of the sovereignty of the constitution in the face of international legislation in accordance with the requirements of the principle of legality. The control of international treaties varies from state to state. Some of them have followed the method of judicial supervision such as Egypt, others have adopted a policy of censorship such as Algeria.
