السلطة التنظيمية في ظل التعديل الدستوري لسنة 2020، The Regulatory Authority Under The Constitutional Amendment Of The Year 2020

Résumé: تعتبر السلطة التنظيمية المستقلة من الاختصاصات المخولة دستوريا لرئيس الجمهورية، وهي سلطة ذاتية لا يجوز تفويضها ، اما السلطة التنظيمية الفرعية فهي مخولة للوزير الأول يمارسها تنفيذا للقوانين والتنظيمات الرئاسية، وتحتل التنظيمات المستقلة مكانة هامة في النظام الدستوري الجزائري خاصة وان مجالها مطلق وغير محدود عكس مجال البرلمان وبالنظر لأهميتها وجب اخضاعها لرقابة كل من القضاء الدستوري وكذا الإداري The independent authority of regulations is considered to be one of the powers constitutionally granted to the President of the Republic. It is a subjective authority that may not be delegated. Whereas the subsidiary authority of regulations is vested to the Prime Minister, who exercises it in implementing the presidential laws and regulations. Independent regulations occupy an important place in the Algerian constitutional system, especially since their scope is absolute and unlimited, unlike that of Parliament. Regarding this importance, they must be subject to the oversight of both the constitutional judiciary as well as the administrative one as well.
