قيود النشاط المقاولاتي للجمعيات في المجتمع الجزائري

Résumé: ملخص يعتبر الهدف الرئيسي الجمعيات الخيرية ذات المنفعة العامة هو تحقيق التنمية الاجتماعية وهو ما تسعى الجزائر إليه، فلتحقيق التنمية وجب على السلطة الجزائرية ترقية هذه الجمعيات من خلال خلق إطار قانوني خاص بها يضفي عليها صفة المؤسسة وإخراجها من قانون 12/06 الخاص بالجمعيات التي تأسست عليه، حيث أظهرت الدراسات أنه قانون يكبح المبادرة المقاولاتية لديها من خلال تضييق الحكامة وحصر موارد التمويل لديها. وعليه على الحكومة الجزائرية إعادة النظر إلى هذه الجمعيات الخيرية ذات المنفعة من خلال حصرها وإعادة تأسيسها ضمن إطار تشريعي جديد كمؤسسات اجتماعية مستقلة إلى جانب توسيع موارها المالية من خلال خلق صندوق للاستثمار الوقفي وذلك باعتبار أن الوقف أهم مواردها. وعليه تتحول هذه الجمعيات الخيرية إلى مؤسسات اجتماعية مقاولاتية تهدف إلى تحقيق أهداف اجتماعية مع اكتفائها المالي الضروري لاستمرارها. Abstract Algeria seeks to achieve the social development that charitable associations of public interest aim at; as the main objective of this; Studies have shown that it is a law that curbs its entrepreneurial initiative by narrowing governance and limiting its funding resources. Therefore; the Algerian; government should reconsider these beneficial charities by limiting them and re-establishing them within a new legislative framework as independent social institutions; as well expanding their financial resources through creating an endowment investment fund, considering the endowment as its most important resource; and accordingly, these charities turn into corporate social institutions that aim to achieve social goals with the financial sufficiency necessary for their continuation.
