تفويض الخدمة العمومية للجمعيات الرياضية

Résumé: الملخص: يشكل تفويض الخدمة العمومية للجمعيات موضوعًا مهمًا على المستويين العلمي والعملي، بصفته إحدى طرق إشراك الخواص في تدبير المرفق العام الجاري التوسع في استعمالها بالمجال الرياضي، سواء بسبب الحاجة لطريقة تسيير ملائمة للمنافسات الرياضية بعيداً عن ثقل الإدارات الحكومية، أو للتقليل من أعباء تسيير الأنشطة الرياضية على الموازنة العامة للدولة، أو بسبب اشتراطات الهيئات الرياضية الدولية. المشرع الجزائري تبنى هذه الطريقة في تسيير وتنظيم النشاط الرياضي بداية من سنة1995، وتوسع في الخدمة العمومية المفوضة للجمعيات الرياضية وطرق تفويضها ضمن التعديلات التشريعية المتتالية. في هذا الموضوع نهدف إلى بيان طبيعة الخدمة العمومية المفوضة للجمعيات الرياضية، وطرق تفويضها في التشريع الجزائري باعتبارها إحدى حالات تدبير المرفق العام من طرف الخواص. Abstract: The delegation of public service to associations is an important scientific and practical subject, as a mode of management increasingly used in many fields, including sport in which this method has spread Whether because of the need for an appropriate management mode of the sports activity, Or because of the need to reduce its burden on the state budget, Or because of the requirements of international sports organizations. This type of delegation was adopted by the Algerian legislator from 1995. It was then extended to a number of delegated services and their means of delegation in successive legislative changes. In this respect, we wish to clarify the modalities of public service delegation, and the services delegated to sports associations as persons of private law in Algerian legislation.
