Résumé: أضحت المعاملات بالوسائط الإلكترونية ما بين الأفراد الأكثر شيوعا لدى اللجوء إلى إبرام اتفاقيات محلها سلع أو خدمات خاصة بعد جائحة كورونا - كوفيد 19. لكن هذه المعاملات ونظرا لانعقادها في عالم افتراضي لا تخلوا من مخاطر قد تؤثر على الثقة والأمان ما بين المتعاقدين، لذلك استحدث القانون 15/04 آلية التصديق الإلكتروني التي تستدعي تدخل طرف ثالث يسمى بمؤدي خدمة التصديق، هذا الأخير يكون مسؤولا عن التحقق من صحة المعلومات الواردة في شهادة التصديق التي يصدرها لصالح المتعامل الإلكتروني، وتؤكد توقيعه. ولضمان أكثر ثقة وأمان في مثل هذه التعاملات، فقد أقر القانون 15/04 مجموعة من العقوبات التي تسلط على مؤدي خدمة التصديق والناتجة على الرقابة المفروضة عليه من قبل السلطات المختصة Electronic media transactions between individuals have become the most common when resorting to concluding agreements replaced by special goods or services after Corona - Covid 19 pandemic. However, these transactions, given that they are held in a virtual world, are not without risks that may affect trust and security between the contractors. Therefore, Law 15/04 introduced the electronic certification mechanism that requires the intervention of a third party called the certification service provider, the latter being responsible for verifying the validity of the information received. In the attestation certificate issued in favor of the electronic customer, confirming his signature. To ensure more confidence and security in such transactions, Law 04/15 approved a set of penalties imposed on the certification service performer, resulting from the supervision imposed on him by the competent authorities.
