الهيئات الإستشارية في ظل دستور 2020 - تدعيم وتفعيل أم تكريس -

Résumé: صدر دستور 2020 كقفزة نوعية لبناء الدولة الجزائرية الجديدة التي تقوم على مبادئ الديمقراطية الحقيقية والمشاركة في اتخاذ القرار، لذلك عمل المؤسس الدستوري إلى إحداث مجموعة من الهيئات الدستورية الإستشارية منها ما كان موجود في الدساتير السابقة، ومنها ما تم النص عليه وإحداثه في دستور 2020 وهذا إيمانا منه بأهمية العملية الإستشارية في بناء قرارات سليمة تحقق الهدف المرجو منها خاصة وأن الإستشارة من أهم مراحل الوظيفة الإدارية و ترتبط بالعمل الإداري المعاصر فهي تساعد الجهاز الإداري في الدولة وتسهل عليه إتخاذ القرار، فهل عزز فعلا دستور 2020 مكانة المؤسسات الإستشارية أم أن الأمر لا يتعدى مجرد التكريس الدستوري؟ هذا ما نجيب عليه ضمن هذه الورقة البحثية. Abstract: The 2020 constitution is a qualitative change to build the modern Algerian state based on the principles of true democracy and participation in decision-making, on which the constitutional instigator has worked for the implementation of a set of consultative constitutional institutions, some of which were already designed in previous constitutions, and some were stipulated and introduced by the Constitution of 2020, reflecting his conviction of the importance of the consultative process in drawing up sound decisions that achieve the desired objective, especially since consultation is one of the most important stages of administrative functioning and is linked to contemporary administrative activity, because they helped the administration of the state in order to facilitate its decision-making. Has the 2020 constitution really strengthened the status of consultative institutions, or is it just a constitutional consecration? This is what we answer in this research paper.
