حماية حقوق الورثة -دراسة مقارنة في الفقه الاسلامي و القانون الجزائري

Résumé: "يُعَدُّ موضوع حِمَايَةُ حُقُوق الـورَثَةُ من أهم المواضيع المالية التي خصَّ الله بها عباده ومنحهم إياها, لذلك جاءت هذه الدراسة محصورة في ثلاثة مباحث لتبيين عدة جوانب تتعلق بهذا الموضوع, سواء من جانب الحقوق المتعلقة بالميت والورثة تجاه التركة التي حافظت الشريعة الإسلامية عليها في أحكامها, وتكفل بها القانون الجزائري بتطبيق العدل بين الورثة, ثم تطرقت إلى حماية الورثة من جانب المورث أو من الغير عن طريق حمايتهم من أي تصرف غير مشروع شرعًا وقانونًا يعود بالضرر عليهم, كما وضحت هذه الدراسة جانب أخر وهو الأهم فيها الذي يتعلق بحماية حقوق الورثة من تعسف بعض الورثة فيكمن ذلك عن طريق حمايتهم من استلاء وضياع أموال التركة, فضمان هذا الحق بتطبيق ما جاء في أحكام الشريعة الإسلامية, وتسليط عقوبات قانونية على كل من تعدى عليه. وانْتَهَتْ هذه الدراسة بخاتمة تَضمنت أهَم النتَائِج والتي منها حِرصُ الشريعة الإسلامية والقانون الجزائري على تطبيق الوسَائِل الكَافيةُ لحِمَايةُ حقُوق الـورثَة من الضَيَاع والتَعسُف. ""Summary The issue of protecting the rights of heirs is one of the most important financial issues that God singled out and granted to His servants, so this study was limited to three sections to show several aspects related to this topic, both in terms of the rights related to the deceased and the heirs towards the inheritance that Islamic Sharia preserved in its provisions and ensured. The Algerian law applies justice between the heirs, then it touched upon the protection of the heirs from the side of the inheritor or from others by protecting them from any unlawful behavior that harms them. This lies in protecting them from the appropriation and loss of the estate's money, ensuring this right by applying the provisions of Islamic Sharia and imposing legal penalties on anyone who infringed on it. . This study ended with a conclusion that included the most important results, including the keenness of Islamic Sharia and Algerian law to apply sufficient means to protect the rights of the heirs from loss and abuse. "
