الأحكام الموضوعية لحماية البيئة الطبيعية في القانون الدولي الإنساني

Résumé: إن الهدف الأساسي من الحرب هو اخضاع الخصم باستخدام وسائل وأساليب "مشروعة" فاختيار اطراف النزاع لوسائل وأساليب الحرب ليس بالحق المطلق الذي لا يخضع للقيود، بل إن هناك أحكاما تضمنتها المواثيق الدولية، يتمثل الهدف الأساسي فيها جعل الحرب اكثر انسانية من خلال حماية الأشخاص والأعيان التي لا تعتبر اهدافا عسكرية، ومن ضمن الأعيان التي لا تعتبر اهدافا عسكرية نجد البيئة الطبيعية التي تحظى بالحماية والاحترام أثناء النزاعات المسلحة، و تتنوع احكام حماية البيئة بين الحماية المباشرة التي جاءت بها نصوص خاصة تضمنها البروتكول الاضافي الاول لعام 1977 وحماية غير مباشرة تستند إلى الاحكام العامة التي تحكم سير العمليات العدائية، والأحكام الخاصة بتنظيم استعمال الأسلحة.
