المحادثة المرئية عن بعد بين جائحة كورونا و مبدأ علنية المحاكمات الجزائية

Résumé: الملخص : لقد تمكن قطاع العدالة من قطع أشواط معتبرة في مجال استخدام تكنولوجيا الإعلام والإتصال بدخوله عالم الرقمنة، حيث تمّ تجسيد عديد المشاريع لضمان عدالة عصرية بمعايير دولية. كان أولها القانون 03-15 المؤرخ في 01 فبراير 2015 المتعلق بعصرنة قطاع العدالة والذي استحدث تقنية المحادثة المرئية عن بعد في نطاق الدعوى الجزائية. غير أن هذا القانون لم يلق تطبيقا واسعا إلا بعد ظهور جائحة كورونا وصدور الأمر 04-20 المؤرخ في 30 أوت 2020 المعدّل و المتمم لقانون الإجراءات الجزائية حيث تمّ توسيع العمل بنظام المحاكمة المرئية عن بعد مسايرة في ذلك لتداعيات الجائحة «covid19 ». واعتبارا لكون المحاكمات الجزائية العادلة تتمّ وفقا لإجراءات علنية، فإن تعميم العمل بنظام المحادثة المرئية عن بعد أمر من شأنه أن يمسّ بمبدأ جوهري وهو مبدأ علنية الجلسات. Abstract: The justice sector has been able to make significant strides in the use of information and communication technology by entering the world of digitization, where many projects have been embodied to ensure modern justice with international standards. The first of these was Law 03-15 of February 01, 2015 relating to the modernization of the justice sector, which introduced the technology of remote video chatting within the scope of the criminal case. However, this law did not receive wide application until after the emergence of the Corona pandemic and the issuance of Order04-20 dated August 30, 2020, amending and supplementing the Code of Criminal Procedure, where the work of the remote visible trial system was expanded in line with the repercussions of the pandemic “covid19”. Considering that fair criminal trials are conducted according to public procedures, generalizing the remote videoconferencing system is a matter that would prejudice a fundamental principle, which is the principle of public hearings.
