Résumé: للاستثمار العقاري دور أساسي في التنمية الاقتصادية، لذلك تعتمد الدول على تهيئة مناخ الاستثمار الموائم لتشجيع تملك الأجانب للعقارات بما لا يقل عن الحد الأدنى من الحقوق في البلد المضيف للاستثمار الأجنبي، والجزائر على غرار بعض الدول العربية نظمت في فترة ما مسألة التملك العقاري للمستثمرين الأجانب غير أن ما يعاني منه قطاع العقار في الجزائر قلل من حظوظ المستثمرين في اكتساب ملكية العقارات اللازمة للاستثمار، لذلك جاءت هذه الدراسة قصد البحث عن أهم عقبات تملك المستثمرين الأجانب للعقارات في الجزائر، وانتهت الدراسة بتوصيات جوهرية أهمها أن يكون هناك تشريع خاص ينظم هذه المسألة. Real estate investment has a essential role in economic development, for this reason countries rely on creating the appropriate investment climate to encourage foreigners ownership of real estate with no less than minimum rights in the host country for foreign investment, Algeria like some Arab countries has regulated in a period the ownership of real estate by foreign investors, however, what real estate sector face in Algeria has diminished the chances of foreign investors in acquiring the property necessary for investment, therefore this study came in order to search for the most important obstacles of investors owning real estate in Algeria, Furthermore, the study concluded with essential recommendations, the most important should be a special legislation to regulate this issue.
