Résumé: تعد الأملاك الوطنية صنفا من أصناف الملكية العقارية إلى جانب الملكية الخاصة، والملكية الوقفية، المجسدة بموجب الدستور وبعض النصوص القانونية أهمها القانون 90/30 المتعلق بالأملاك الوطنية و قانون التوجيه العقاري.... وقد أحاط المشرع الجزائري الأملاك الوطنية بجملة من القواعد الآمرة، وضيَق من مجال التصرفات التي يمكن أن ترد عليها، هادفا من وراء ذلك إلى حمايتها باعتبارها ملك للجماعة الوطنية. وإذا قارنا هذه الضوابط بين كل من الأملاك الوطنية الخاصة و الأملاك الوطنية العمومية، لوجدنا حرص المشرع أكثر بالنسبة للنوع الأخير، حيث ضبط جملة من القواعد المتعلقة باستعمال هذه الأملاك مراعيا في ذلك الحق المكرس دستوريا للمواطن فيما يخص الحق في استعمال هذه الممتلكات التي تؤول إلى الجماعة العمومية، والواجب الذي يقع عليه باعتبارها تشكل جزءا من كيان الدولة. Abstract: national property is a class of real estate ownership in addition to private and endowment property embodied in accordance with the constitution ;as well as under some legal texts ; the most important of which is law 90/30 related to national property and the real estate guidance law. The Algerian legislator has surrounded the national properties with a set of rules and narrowed the range of behaviors that are used towards it aiming to protect them as a national property. if we compare these controls between both the private national properties and the public national properties, we will find that the legislator is more keenness regarding the latter type where he has set a group of rules related to the use of these properties taking into account the constitutionally enshrined right for the citizen regarding the right to use these properties that belong to the public group and the duty that falls on it as a part of the state entity.
