دلالة الاقتضاء بين الأصوليين والتداولية، دراسة في التّأويل الصّدقي للأقوال

Résumé: الملخّص: إ ن النظر في مستلزمات الألفاظ وما تحمله من معنى في المستويات المختلفة؛ انطلاقا من مستوى التجريد الأول )الوضع الأول(، إلى مستوى الاستعمال المتداول، وعلاقة المستعمل/ المتكلم بهذه الألفاظ، في السياقات المختلفة والعوالم الممكنة المتحققة، وفي مستواها الخطي والصوتي والتركيبي، و ما تلحقها من إيحاءات ودلالات واقتضاءات وإشا رات؛ تكون متضمنة في العبارة المصرح بها أو غير المص رح بها، وفي وبحثنا هذا نحاول حصر بيئة علم أصول الفقه و البيئة التداولية الحديثة، متناولين دلالة الاقتضاء بشيء من التحليل، و بشيء من أوجه التقارب وأوجه الاختلاف، والتي اقتربت بوجه عام من حصر المعنى وضبط المراد، ومدى مصداقية الأقوال والحكم عليها، بالصحة أو الكذب، وما هي معايير قبول هذه الأقوال ورفضها، وماهي شروط صدقها أو كذبها؟ Abstract : Words implications and their meanings at different levels; starting from the level of abstraction (the first convention) to the level of frequent usage, and the user / speaker relationship with these words in different contexts and possible worlds, in linear, vocal and syntactic level, as well as their indications, significations and implications; are included in the explicit or implicit expressions. In this research, we try to limit the environment of jurisprudence and the modern pragmatic environment In order to analyze the signification of implications and show points of convergence and differences, Which is generally close to limiting the meaning and the defining the aim, the credibility of the words and the judgments; whether they are right or wrong, and What are the criteria for accepting and rejecting these statements, and the conditions of their sincerity or falsehood?
