معايير صحة سقوط الحق في الضمان في عقد التأمين Criteria For The Validity Of The Right To Forfeit The Guarantee In The Insurance Contract

Résumé: ان الحق في الضمان والذي أقره المشرع سواء في القواعد العامة أو القاواعد الخاصة بموجب القانون يعد بمثابة أهم الحقوق التي تلي إبرام العقد بالإضافة إلى الحق في التعويض إلا أن هذا الحق قد يكون عرضة للسقوط سواء بموجب القانون أو الإتفاق وذلك عن طريق الإخلال ببعض الإلتزامات والإجراءات ، كما أن سقوط الحق في الضمان يفترض نشوء أو قيام هذا الحق ، فالسقوط يعتبر بمثابة الجزاء أو العقوبة التي تلحق بصاحب الحق ، غير أنه وفي مقابل ذلك ،فإن هذا الحق لا يقوم إلا بتوافر شروط معينة وإتباع إجراءات محددة قانونا من شأنها تحقيق التوافق بين عدم تعسف المشتري في إستعماله من جهة وبين جبر الضرر اللاحق به من جهة أخرى. Forfeiture is regarded as a penalty or punishment inflicted on the right holder, but in return for that, this right does not exist unless certain conditions are met and legally specific procedures are followed that will achieve compatibility between the non-arbitrariness of the buyer In its use on the one hand, and the reparation for the harm suffered on the other hand.
