البيع الواقع على حصة شائعة في عقار

Résumé: تعالج هذه الدراسة، مدى صحة تصرف الشريك المشتاع ببيع حصته الشائعة في عقار، وفق ما جاء به المشرع المدني الجزائري، حيث أقر هذا الأخير جملة من الأحكام لتنظيم التصرفات الواقعة على حصة شائعة في عقار مراعياً في ذلك نقطتين مهمتين، تتمثل الأولى في إعطاء الشريك الحق في التصرف باعتبار أن حق الملكية حق مقدس مكفول دستورياً، ولأن التصرف فيه أهم ما يميزه؛ والنقطة الثانية ولنفس الغرض وهو حماية حق الملكية، اشترط ألا يضر التصرف باقي الشركاء، لأن لهم نفس الحقوق على الحصة الشائعة المتصرف فيها. بناءً على ما تقدم نتناول هذه الأحكام و القواعد مع الشرح و التمحيص محاولين رفع اللبس و الغموض واستعراض الإشكالات و إيجاد الحلول الممكنة لها في هذه الدراسة. This study deals with the validity of the behavior of the common partner by selling his common share in a property, according to the Algerian civil legislator. The latter approved a number of provisions to regulate the behavior of a common share in a drug taking into consideration two important points: To act as the right of ownership is a sacred right guaranteed constitutionally, and because the disposition of the most important characteristic of it; and the second point and for the same purpose is the protection of the right of ownership, provided that the behavior does not harm the rest of the partners, because they have the same rights to the common share managed. Based on the above we deal with these rules and rules with explanation and scrutiny, trying to raise confusion and ambiguity and review the problems and find possible solutions to them in this study.
