Résumé: Executive Decree 20-373 came in implementation of Articles 132, 139, 144, 153 of Ordinance 06-03, which defined five various situations in which a public official can be placed in a legal position of different rights and duties, namely: carrying out the service, assignment, outside the framework, referral, to the deposition, National Service. The aim of the study is to clarify the issues that are identical between the legislative and regulatory text, and the details updated in the decree that were not addressed in the matter, and through that I came to the conclusion that the regulator in Articles: 03, 04, 05, 06, 07, of the decree wanted to detail the situation Carrying out the service, it feel into repetition, ambiguity, and inaccuracy in the use of legal terminology. جاء المرسوم التنفيذي20-373 تطبيقا للمواد132، 139، 144، 153 من الأمر 06-03، واللذان حددا خمسة وضعيات متنوعة يمكن أن يوضع فيها الموظف العمومي مركزها القانوني من حقوق وواجبات مختلف وهي: القيام بالخدمة، الانتداب، خارج الإطار، الإحالة على الاستيداع، الخدمة الوطنية. والهدف من الدراسة هو تبيان المسائل التي تكون متطابقة بين النص التشربعي والتنظيمي، والتفاصيل المستحدثة بالمرسوم والتي لم يتطرق إليها الأمر، ومن خلال ذلك توصلت إلى نتيجة هي أن المنظم في المواد: 03، 04، 05، 06، 07 من المرسوم أراد التفصيل في وضعية القيام بالخدمة فوقع في التكرار، والغموض، وعدم الدقة في استعمال المصطلحات القانونية.
