مسؤولية الاحتلال الاسرائيلي عن جرائمه في فلسطين

Résumé: الملخص: أردنا البحث في مسؤولية الدولية و التوغل في الجرائم الحرب التي اقترفها الكيان الصهيوني – إسرائيل- في حق الشعب الفلسطيني وأرضه، من سنة 1948 الى غاية اليوم، مع الوقوف على محطات شكلت عدوان مثل سنة 2008 تاريخ العدوان على غزة، وبهذا أردنا كذلك أن يكون الطرح يتراوح بين الجانب الديني الذي يعتبر في نظر اليهود أساسي في احتلالهم للفلسطين، حيث كييفت اسرائيل حربها من خلال حركة غوش إيمونيم Goush Emounim التي لم تعترف بنشأة حق لغير اليهود، و الجانب الخاص بالنظريات والقوانين الوضعية التي نطرح من خلالها وجود فلسطين قبل وعد بلفور الوثيقة السياسية التي حولت فلسطين من دولة الى لا دولة بعد دخول المحتل الاسرائيلي إليها ، ومع ذلك وباعتبارها الدولة القائمة بالاحتلال تتحمل المسؤولية الكاملة عن الأفعال غير المشروعة، لهذا القانون الدولي دائما يريد أن يجد حلول لجرائم الحرب الاسرائيلية على الشعب الفلسطيني الذي يعتبر الجزء من الكل، ومنها العدوان الذي قام به المحتل الكيان الصهيوني باستهداف مدنيين فلسطينيين و الذي استخدم فيه أنواع الأسلحة المحرمة دوليا، لنصل الى سبل إدانة مجرمي الحرب ومحاكمتهم أمام المحكمة الجنائية الدولية أو إحداث محاكم دولية خاصة. Abstract: We wanted to discuss the international responsibility and to penetrate the war crimes committed by the Zionist entity - Israel - against the Palestinian people and their land, from 1948 until today, while standing on the stations that constituted aggression such as the year 2008, is the date of the aggression on Gaza, and with this we also wanted the proposal to be It ranges between the religious aspect, which in the eyes of the Jews is essential in their occupation of Palestine, where Israel adapted the war through the Gush Emounim movement, which did not recognize the originate of a right for non-Jews, and private side of the man-made theories and laws through which we put forward the existence of Palestine before the Balfour Declaration, the political document Which turned Palestine from a state to a non-state after the Israeli occupier entered it, yet as the occupying state bears full responsibility for the illegal acts, the international law always wants to find solutions to the Israeli war crimes against the Palestinian people who are part of the whole, including aggression, What the occupier carried out by targeting Palestinian civilians, in which it used types of internationally prohibited weapons, and access to convict war criminals and try them before the Criminal Court international, or the creation of special international courts.
