معوقات تطبيق نظام التقاضي الالكتروني في الجزائر

Résumé: كان للتطور التكنولوجي والثورة الرقمية الأثر المباشر على المجال القضائي الذي واكب هذه العصرنة وتبناها بدخوله عالم الرقمنة، فتم تطبيقا لتقاضي الالكتروني،باعتباره أحد آليات الرقمنة،يفترض فيه أن يكون تكريسا لمزيد من الضمانات التي تتجسد أساسا في سرعة معالجة الملفات والفصل فيها، وتسهيلا للجوء للقضاء،وتبسيطا لإجراءات، فأقر المشرع الجزائري ما يسمى برقمنة قطاع العدالة. لكن في الممارسة العملية تواجه رقمنة هذا القطاع سلسلة من العقبات، على أساس أن التحول الإلكتروني للإدارة عموما لا يعني أن الطريق ممهد لتطبيقها وتنفيذها بكل سهولة، بل هناك العديد من العراقيل التي يمكن تقسيمها إلى: معوقات قانونية، ومعوقات مرتبطة بالمورد البشري، ومعوقات مادية. الكلمات المفتاحية : التقاضي الالكتروني، رقمنة العدالة، العدالة الالكترونية، التحدي الالكتروني، معوقات التقاضي الالكتروني. Abstract: Technological development and the digital revolution have had a direct impact on the judicial sphere, which has kept pace with this process and adopted it by entering the world of digitization. Thus, the application of what is known as electronic litigation as one of the mechanisms of digitization, which is supposed to be the consecration of more guarantees, mainly in the speed of processing and processing of files, in order to facilitate access to justice and to simplify procedures.
