الجريمة الصحفية في التشريع الجنائي الجزائري
Résumé: لا شك أن الصحافة تعد واحدة من أهم وسائل التعبير عن الرأي في المجتمع المعاصر وقد حرصت مختلف التشريعات على تنظيم الصحافة لضمان حقوق الفرد والمصلحة العامة للمجتمع. وفي هذا السياق تأتي دراستنا للكشف عن مختلف الجرائم الصحفية المرتكبة عن طريق الصحافة في التشريع الجزائري وتبيان الجزاء لكل واحدة منها. وتسعى هذه الدراسة إلى الإحاطة بكل جريمة صحفية من خلال إبراز تعريفها وأركانها والجزاء المترتب عليها وأثرها على الفرد والمجتمع ومها تم العمل على توفير الضمانات الدستورية والقانونية من طرف التشريع والقضاء فانه تبقى الممارسة الصحفية السليمة هي أفضل ضمانة لحرية الصحافة وللوصول في آن واحد. There is no doubt that the press is one of the most important means of expression in contemporary society. The various legislations have been keen to organize the press to guarantee the rights of the individual and the public interest of society. In this context, our study comes to reveal the various press crimes committed by the press in the Algerian legislation and to indicate the penalty for each of them. This study seeks to capture every journalistic crime by highlighting its definition, its elements, its consequences, and its impact on the individual and the society. Constitutional and legal guarantees have been provided by the judiciary and the judiciary. The proper press practice is the best guarantee for freedom of the press and access at the same time.
