سبل تمويل الحملات الانتخابية والرقابة عليها في التشريع الجزائري -دراسة في ظل الأمر 21/01- Provisions For The Financing And Control Of Electoral Campaigns In Algerian Legislation: A Study Under Ordinance No. 21/01

Résumé: نوع المشرع الجزائري في عملية تمويل الحملات الانتخابية، حيث جعلها تتم بواسطة موارد يكون مصدرها إما مساهمة الأحزاب السياسية المشكلة من اشتراكات أعضائها والمداخيل الناتجة عن نشاط الحزب، أو المساهمة الشخصية للمترشح من خلال الهبات النقدية أو العينية المقدمة من طرفه أو من طرف المواطنين كأشخاص طبيعية، بالإضافة إلى المساعدات المحتملة التي يمكن أن تمنحها الدولة للمترشحين الشباب في القوائم المستقلة بمناسبة الانتخابات التشريعية والمحلية. هذا وقد أنشأ المشرع الجزائري لجنة لدى السلطة الوطنية المستقلة للانتخابات مهمتها ممارسة الرقابة المالية على الحملة الانتخابية تمويلا وإنفاقا من خلال مراجعة صحة ومصداقية العمليات المقيدة في حساب الحملة الانتخابية تمهيدا لإمكانية تكفل الدولة بتعويض لجزء من نفقات الحملة الانتخابية. The Algerian legislature has diversified in financial operations of electoral campaigns, where its revenues are made by means of resources derived either from the contribution of political parties, which are collected from their members and the income resulting from the party's activities, or the personal contribution of the candidate through cash, donations made by the candidate himself, or by citizens, in addition to potential State assistance to young candidates on independent lists during legislative and local elections. It is worth mentioning that the Algerian legislature has established a commission within the Independent National Electoral Authority to exercise financial control over the electoral campaign in terms of funding and expenditure by reviewing the validity and credibility of the processes restricted in the electoral campaign account in order to ensure that the State’s compensation for part of the campaign's expenses.
