تمويل الحملات الانتخابية في ظل الأمر 21/01 المتضمن القانون العضوي المتعلق بنظام الانتخابات

Résumé: يعد تمويل الحملات الانتخابية موضوعا بالغ الأهمية،لأنه يشكل عاملا محوريا في توجيه نتيجة الانتخابات وجهة معينة ،أي لصالح مترشح أوحزب دون غيره وبالتالي المساس بنزاهة وشرعية العملية الانتخابية برمتها. لهذا وخوفا من اللجوء إلى مصادر مالية غير مشروعة ،وتفاديا للتمويل المشبوه وتوظيف المال الفاسد في الانتخابات، عمد المشرع الجزائري على غرار التشريعات المقارنة إلى إعادة النظر في تمويل الحملة الانتخابية من خلال تأطير هذه العملية ، وفقا لأحدث النصوص القانونية بموجب الأمر 21/01 وإخضاعها لتنظيم تشريعي صارم ورقابة مشددة وتنصيب لجنة خاصة تضطلع بذلك إبعادا للمال الفاسد من السياسة وضمانا لمبدأ المساواة وتكافؤ الفرص بين جميع المترشحين. الكلمات المفتاحية: انتخابات ؛لجنة مراقبة؛ تمويل عمومي؛ تمويل خاص. Financing elections has a great importance.It is a fundemental factor which can guide the results in favor of some members or political parties rather than others.This is illegal and illegitimate . Therefore,for fear of resorting to illegal financial sources ,and in order to avoid suspicious fina,cing and the use of corrupt money in the elections, the legislator,along the lines of comparative legislation, reconsidered the financing of electoral campain in accordance with organic law 21/01 to strict legislative regulation and strict control, and the installation of a special committee to remove corrupt money from politics and to ensure the principle of equality and equal opportunities for all candidates.
