الصياغة التشريعية وتحقيق الامن القانوني

Résumé: ملخص: تعتبر الصياغة التشريعية الجيدة الطريق للوصول إلى سن تشريع متطور واضح المعاني قابل للفهم والتطبيق، وبذلك يتحقق هدف القانون المتمثل في تنظيم سلوك الأفراد في المجتمع، ويعتبر مبدأ الأمن القانوني من ضمن أهم المبادئ التي تسعى معظم الدول إلى تجسيدها في نظامها التشريعي، لتحقيق دولة القانون وما ينجم عنه من حماية للحقوق والمراكز القانونية للأفراد. ونهدف من خلال هذا المقال الى ابراز مفهوم الصياغة القانونية، وتحديد شروط وضوابط الصياغة الجيدة ومراحلها، ونؤكد على العلاقة بين الصياغة القانونية والأمن القانوني، وتوصلنا الى أن الصياغة التشريعية عملية ضرورية لترجمة مضمون النص القانوني وتحويله الى قاعدة قابلة للتطبيق كما أن الصياغة التشريعية السليمة تسمح بفهم احكام النصوص القانونية وبالتالي تحقيق الأمن القانوني. كلمات مفتاحية: الصياغة، التشريع، الصياغة التشريعية، الجودة. Abstract: Good legislative wording is the way to enact sophisticated legislation that is clearly understood and applicable, thereby achieving the law's objective of regulating the conduct of individuals in society. The principle of legal security is one of the most important principles that most States seek to embody in their legislative system, in order to achieve the rule of law and the resulting protection of the legal rights and status of individuals. Through this article, we aim at highlighting the concept of legal wording, identifying the conditions and disciplines of good drafting and their stages, emphasizing the relationship between legal wording and legal security, and finding that legislative drafting is a necessary process to translate the content of the legal text into a viable rule.
