المكافحة الدولية والوطنية للإباحية الإلكترونية من منظور قانوني

Résumé: الملخص : إن ثورة التكنولوجيا قد غيرت مجرى العالم في مختلف مناحي الحياة، أهمها جعل العالم قرية صغيرة بفضل وسائل الإتصال الحديثة، لاسيما ما تعلق منها بالأنترنت، هذه الأخيرة التي أفرزت إلى جانب إيجابياتها جملة من السلبيات وصلت إلى درجة إفساد أخلاق الشعوب والمجتمعات، فكانت الإباحية الإلكترونية أحد صور هذا الفساد، وهو مابيناه على ضوء دراستنا هذه من خلال معرفة صور انتشارها، مما أدى بالمجتمع الدولي إلى وضع جملة من الضوابط القانونية والإدارية لمكافحة هذا النوع من الجرائم على كلا المستويين الدولي والوطني، من خلال التدابير الوقائية التي تمنع من الوصول إلى تحقيق الغاية الإجرامية، والتدابير العقابية التي من شأنها تسليط الجزاء على مرتكبيها ، والتي تبقى مرهونة حسب دراستنا و تحليلنا الى ضرورة تكثيف الجهود الدولية لمحارية هذه الجريمة و لاسيما وأنها تشكل جريمة عابرة للحدود. The technology revolution has changed different aspects in life , especially that it makes the world became like a small village, due to the different modern communication channels, particularly which are related to internet. Besides that The Network has an advantages also has produced number of negative effects that reached the level of corrupting peoples and societies stands and behaviors and the electronic pornography was one of the bad effects, this has led the international community to decide a serious legal and administrative controls to combat this type of crime at the international and national both levels, through a curative measures that prevent access to the criminal end without forgetting punitive measures that the punishment would be shaded on the perpetrators, which remains according to our studies and analysis to the need of intensify international efforts to marginalize this crime, especially as it constitutes a transboundary crime.
