التكوين العرفي لمبادئ القانون الدولي للفضاء

Résumé: دراسة المسائل المرتبطة بالتكوين العرفي لمبادئ القانون الدولي للفضاء، تحظى بأهمية بالغة، من حيث تسليط الضوء على أحد أهم مصادر القاعدة القانونية الدولية، المتمثلة في العرف الدولي، ودوره في تكوين النظام القانوني للفضاء الخارجي. أنكر جانب من الفقه الدولي، إمكانية وجود قواعد عرفية في مجال القانون الدولي للفضاء، غير أن الواقع أثبت العديد من الممارسات الدولية في مختلف مجالات الأنشطة الفضائية، تجمع العنصرين الأساسيين المكونين للقاعدة العرفية، ألا وهما المادي والمعنوي. هذه القواعد والمبادئ العرفية، تستجيب لخصوصية الأنشطة الفضائية من حيث سرعة تطورها، وقد ساهم في تكوينها، العديد من الإعلانات والتوصيات الصادرة عن الجمعية العامة للأمم المتحدة، والجهود المعتبرة للجنة الإستخدامات السلمية للفضاء الخارجي. The study of issues related to the customary formation of principles of international space law is of great importance to identify one of the most important sources of international legal rule, which is international custom, in order to study its role in the legal system formation of the international outer space law. Part of international doctrine has denied the existence of customary rules in the field of international space law. However, reality has proven many international practices in various fields of space activities which combine the two elements of customary, material and psychic rule. These customary rules and principles respond to the specificity of outer space activities and its rapid development, in addition to numerous declarations and recommendations issued by the United Nations General Assembly, and the important efforts of the Committee on the Peaceful Uses of Outer Space, contributed to the formation of international custom.
