Résumé: تعد عقود البيع بالمزايدات العلنية عبر الانترنت من العقود الأكثر استعمالا ورواجا في وقتنا الحالي من خلال مواقع المزايدات الالكترونية لبيع السلع والخدمات، فهو بيع بالمزاد العلني يتولاه شخص بوصفه وكيلا عن المالك بعرض المال في المزاد العام بالطريق الالكتروني عن بعد بقصد إرساءه على أفضل عرض مقدم من المتزايدين ومن ضمن الإشكالات التي أهمل المشرع الجزائري وضع قواعد تشريعية لها ضمن قانون رقم 18-05 المتعلق بالتجارة الالكترونية الجزائرية هي مسألة البيع بالمزاد العلني الالكتروني. Online auction sales contracts are more widely used and popular contracts nowadays through electronic bidding sites to sell goods and services, it is a public auction sale by a person as an agent of the owner by displaying money in the public auction via the Internet remotely with the intention of awarding it to the best offer submitted by bidders. One of the problems that the Algerian legislator has neglected to lay down legislative rules for in Law No. 18-05 related to Algerian electronic commerce is the issue of online auction sales.
