التعاملات المنصبة على التجهيزات الحساسة على ضوء القانون الجزائري.

Résumé: ملخص: يكشف المقال عن مفهوم التجهيزات الحساسة و أنواعها و كذا المقتضيات التي تستدعي تصنيفها كمعدات من هذا القبيل ،وتبيان دواعي تقييد استعمالها و استغلالها و تسويقها . يهدف البحث إلى تبيان الإجراءات المتبعة في مجال التعامل بالتجهيزات الحساسة سواءا من قبل الأفراد أوالمتعاملين في المجال التجاري و إبراز أهمية الضبط التشريعي و الإداري لهذا الميدان ،بما في ذلك كشف الإستخدام غير المشروع لتلك التجهيزات و قمع الجرائم المرتبطة بها. تخلص الدراسة إلى أن تقييد حرية التعامل في التجهيزات الحساسة تفرضه مقتضيات حفظ الأمن الوطني وصون النظام العام و حماية الحياة الخاصة للأفراد و أنه ينبغي توخي أعلى درجات الوعي واليقظة في هذا المجال في ظل الإستخدام المتزايد للوسائل التكنولوجية في النشاطات الإجرامية الماسة بأمن المجتمعات والدول و استقرارها. Abstract: The article reveals the concept of sensitive equipment, its types, and the requirements that require its classification as such equipment, and explains the reasons for restricting its use, exploitation, and marketing. The research aims to clarify the procedures followed in the field of dealing with sensitive equipment, whether by individuals or those dealing in the commercial field, and to highlight the importance of legislative and administrative control in this field, including detecting the illegal use of such equipment and suppressing crimes related to it. The study concludes that restricting the freedom to deal with sensitive equipment is imposed by the requirements of preserving national security, maintaining public order, and protecting the private lives of individuals, and that the highest levels of awareness and vigilance should be observed in this field in light of the increasing use of technological means in criminal activities that affect the security and stability of societies and countries.
