مظاهر الإخلال بمبدأ حسن النية في الإيجاب والقبول للعقد الإلكتروني

Résumé: إن الهدف من هذا البحث ليس النظر في الشروط التي يتطلبها القانون في التعبير عن الإرادة العقدية الإلكترونية، إذ أن الهدف من هذه الدراسة يتمثل في النظر في مظاهر الإخلال بمبدأ حسن النية في العنصر الجديد الوليد في أنواع العقود وهو العقد الإلكتروني، ومنه البحث في مدى تأثير خصوصية وطبيعة التعاقد الإلكتروني على الإيجاب والقبول الإلكترونيين وكذا مبدأ حسن النية في هذا النوع من العقود ومدى إيجاد حلول مناسبة لذلك، خصوصا وأن مبدأ حسن النية من المبادئ القانونية التي لا يمكن إنكارها أو التغافل عن وجودها لما لها من أهمية في القانون ، حيث يترتب على مراعاتها تطبيق أحكام القانون وعلى معارضتها مخالفة القانون Abstract: The aim of this study is not to consider the requirements that the law requires in expressing the electronic contractual will , as the goal is to look at the manifestations of the breach of the principle of good feith in the new element emerging in the types of contracts which is the electronic contract. It includes research on the extent of the privacy and nature of the electronic contract on the electronic offer and acceptance, as well as the principle of good feith in this type of contract and the extent of finding appropriate solution for that, especially since the principle of good feith is one of the legal principles that cannot be denied or overlooked due to its importance in law, as theire observance of the provosions of the law shall apply and their opposition is aggainst the law .
