النظام القانوني للخبرة في المادة العقارية

Résumé: ملخص : ان القاضي للإلمام بجميع الجوانب التي يقوم عليها حكمه القضائي يقوم بجمع الأدلة والبراهين بعنايته الشخصية فإذا استعصت عليه بعض الأمور وجب عليه الأخذ برأي من لهم علم كافي أو تجربة في الميدان محل البحث،عن طريق احد اهم وسائل الاثبات ألا و هو الخبرة القضائية. وللخبرة القضائية أهمية بالغة في حياتنا وتعاملاتنا لا سيما في المجال العقاري هذا الأخير الذي يتسم بالتعقيد لأنه يمس بالحقوق اللصيقة بالإنسان والمنازعات المثارة في هذا الميدان تعتمد أساسا على الدقة لما لها من أهمية بالغة في حياة الإنسان. حيث توجد قضايا لا يمكن الفصل فيها دون الرجوع إلى أهل الاختصاص لما تتطلبه من دقة في البحث والتحري فقد أجاز المشرع الجزائري للقاضي الرجوع إلى من تتوفر فيهم الكفاءة العلمية اللازمة لاستشارتهم في بعض المسائل التقنية والفنية. الكلمات المفتاحية : الخبرة ؛ القضائية ؛ المنازعات ؛ العقارية. *المؤلف المرسل : مبروك حدة Abstract: In order to embrace all the aspects that the judicial decision stands for, the judge tends to collect evidence and proofs with special care. In case things proved intricate, she must seek the opinion of those knowledgeable and experienced in the respective research field, through one of the most crucial means of evidence – namely, judicial expertise. Judicial expertise is of great significance in our lives and our dealings, especially in real estate. The latter is complicated by the fact that it affects the human rights and the disputes raised in this field, which depends mainly on accuracy, because it is extremely important in the human life. There are cases that cannot be adjudicated without referring to specialists, due to the accuracy they require in research and investigation. Accordingly, the Algerian legislation has permitted the judge to refer to those who meet the necessary scientific competence in order to consult them regarding some technical and substantive issues.
