صلاحيات المحكمة الدستورية في ظل التعديل الدستوري لسنة 2020

Résumé: أقر التعديل الدستوري لسنة 2020 المحكمة الدستورية كآلية مستحدثة للرقابة على دستورية القوانين كبديل عن الآلية التقليدية المجلس الدستوري، وهو ما يلزمنا بدراسة هذه المحكمة والنظر في اختصاصاتها سواء تلك الموروثة عن المجلس الدستوري أو تلك المستحدثة. وقد وسع المؤسس الدستوري من صلاحيات هذه المؤسسة، حيث مكن لها الرقابة على التنظيمات وكذا تفسير نصوص الدستور إلى جانب النظر في الخلافات التي تكون بين السلطات الدستورية في الدولة ورفع الحصانة عن أعضاء البرلمان، وجملة من الاختصاصات الأخرى. Abstract: The constitutional amendment of 2020 approved the Constitutional Court as a new mechanism for monitoring the constitutionality of laws as an alternative to the Constitutional Council, which obliges us to study this court and consider its jurisdiction, whether those inherited from the Constitutional Council or those newly created. The constitution expanded the powers of this institution, as it enabled it to supervise organizations as well as interpret the provisions of the constitution, in addition to examining disputes that arise between the constitutional authorities, and a number of other specializations.
