عقود التعمير في ظل المرسوم التنفيذي 20/342 المعدل و المتمم للمرسوم التنفيذي 15/19

Résumé: ان موضوع التعمير يكتسي أهمية بالغة في الوقت الحالي نظرا للتوسع الحضري والنمو الديمغرافي، هذه المتغيرات استوجبت البحث عن سياسة تعمير في مستوى هذه التحديات لملائمة الاوضاع الاقتصادية والاجتماعية والسياسية ،ويعتبر القانون رقم 90/29 المؤرخ في 01 /12 /1990 اول نص قانوني يجسد استراتيجية البناء ونظام تعمير المدن بمفهومه الحديث ويكمله عدة مراسيم تنفيذية رقم 91/175 المؤرخ في 28ماي 1991المحدد لكيفيات اعداد تسليم شهادة التعمير ورخصة التجزئة ،وشهادة التقسيم ورخصة البناء وشهادة المطابقة ،ورخصة الهدم المعدل والمتمم والذي تم الغاءه بموجب المرسوم التنفيذي 15/19 المؤرخ في 25 جانفي 2015 المحدد لكيفيات تحضيرعقود التعميرو تسليمها ،والذي اعتبر الرخص والشهادات عبارة عن قرارات فردية تخضع لنفس الشروط و لها نفس خصائص القرار الاداري، ثم عدل بمرسوم تنفيذي رقم 20/342المؤرخ في 22 نوفمبر 2020 .و الذي جاء بمجموعة من المواد المستحدثة و المعدلة تتعلق بالطعن و الآجال المرتبطة به . Law n ° 90-29 of May 18, 1991 is considered to be the first legal text which embodies the construction strategy and the urban reconstruction system in the modern sense and completed by several Executive Ceremonies n ° 91-175 of May 28, 1991 specifying the modalities of preparation for the issuance of the construction certificate, the trade permit, the partition certificate, the building permit, the certificate of conformity, and the modified and completed demolition permit, which was cancelled by Executive Decree 19 of January 25, 2015 specified For the procedures for preparing and issuing construction contracts, which considered authorizations and certificates as individual decisions subject to the same conditions and having the same characteristics as the administrative decision, then modified by Executive Decree No. 342 -20 of November 22, 2020, which came with a set of new and amended articles relating to the remedy and associated time limits.
