الخطأ الطبي في قضاء مجلس الدولة الجزائري

Résumé: من أجل إثبات الخطأ الطبي أو الخطـأ المرفقي للمستشفى العمومي أخذ القاضي الإداري بمضمون تقرير الخبرة في العديد من القرارات، كما أنه شكل تصرف عدم المراقبة والتقصير في العناية أساسا لمسؤولية المستشفى في قضاء مجلس الدولة الجزائري. كما أنه لجأ القاضي الإداري إلى أدوات أخرى لإثبات الخطأ الذي تتحمل التعويض عن أضراره المستشفى، من بين هذه الأدوات نجد تقرير الطبيب الشرعي، الارساليات الإدارية ومحضر الضبطية القضائية، كما أن القاضي الإداري لم يفرق بين الخطأ الجسيم والخطأـ البسيط بخصوص الخطأـ الطبي In order to prove the medical error or the accompanying error of the public hospital, the administrative judge took the content of the experience report in many decisions, and the act of non-supervision and negligence in caring constituted the basis for the hospital’s responsibility in the Algerian State Council. The administrative judge also resorted to other tools to prove the error that bears compensation for the hospital's damages, among these tools we find the forensic doctor’s report, the administrative dispatches and the judicial seizure report, and the administrative judge did not differentiate between the serious error and the simple error regarding the medical error.
