حدود إخطار المجلس الدستوري في النظام الدستوري الجزائري

Résumé: ملخص: تعتبر الرقابة الدستورية أحد أهم ركائز دولة القانون، وقد أسند المؤسس الدستوري الجزائري هذه المهمة للمجلس الدستوري باعتباره الجهاز المكلف بالسهر على حماية الدستور، إلا أن ممارسة المجلس الدستوري لهذا الإختصاص الرقابي متوقف على إعمال آلية الإخطار لكونها الوسيلة الوحيدة لتحريك الرقابة الدستورية، حيث منح الدستور الجزائري قبل التعديل الدستوري لسنة 2016 هذا الحق لثلاث هيئات أو أطراف معينة دون غيرها، الأمر الذي انعكس على نشاط المجلس وفعالية دوره الرقابي، وقصد تدارك هذه الوضعية التي اتسمت بمحدودية جهات الإخطار، أقر التعديل الدستوري لسنة 2016 توسيع نطاق الإخطار ليشمل جهات جديدة، الأمر الذي يتيح للمجلس الدستوري توسيع فرص ومجالات تدخله. الكلمات المفتاحية: المجلس الدستوري. الرقابة الدستورية، الإخطار، الدفع بعدم الدستورية، أعضاء البرلمان. Abstract: Constitutional authority is one of the most important pillars of the rule of law. The Algerian constitutional institution has entrusted this task to the Constitutional Council as the organ entrusted with protecting the constitution. However, the Constitutional Council's exercise of this jurisdiction depends on the implementation of the notification mechanism as the only means of activating constitutional control. Prior to the constitutional amendment of 2016, this right was granted to only three bodies or parties, which was reflected in the activity of the Council and the effectiveness of its oversight role. In order to rectify this situation, which was characterized by limited notification bodies, Notification of Aq to include new destinations, allowing the Constitutional Council to expand opportunities and areas of intervention.
