Résumé: استحدثت العديد من التشريعات الشهادة المجهلة في نطاق الدعوى الجنائية كوسيلة قانونية تهدف من خلالها إلى توفير حماية للشهود عن طريق إخفاء بياناتهم؛ بتجهيل هذه البيانات وحجبها عن المتهمين وباقي الخصوم في الدعوى؛ غير أنه لإضفاء الحماية على الشاهد عن طريق التجهيل؛ لا بد أن تتوافر مجموعة من الضوابط نصت عليها كل التشريعات الإجرائية التي عملت بها، وحاولنا من خلال هذه الدراسة معرفة الضوابط القانونية التي جاء بها المشرع الجزائري مقارنة بالمشرع الفرنسي من أجل العمل بالشهادة المجهلة في نطاق الإجراءات الجنائية . Abstract: Many legislations have introduced anonymous testimony within the scope of criminal proceedings as a legal means through which they aim to provide protection for witnesses by concealing their data; by making this data unknown and withholding it from the accused and the rest of the opponents in the case; however, in order to provide protection to the witness through anonymity; a set of conditions must be available that are stipulated in all procedural legislations that have been implemented, and through this study we have tried to know the legal controls that the Algerian legislator has introduced compared to the French legislator in order to work with anonymous testimony within the scope of criminal procedures.
