مكانة الركن المادي للمضاربة غير المشروعة في ظل القانون رقم 21/15

Résumé: تعد جريمة المضاربة غير المشروعة إحدى الممارسات التي باتت تؤرّق المستهلك وتهدد أمن واستقرار المجتمع، خاصة في ظل تفشي جائحة وباء الكوفيد 19 أين كان المواطن الجزائري يتفاجىء في كل مرة باختفاء بعض السلع من الأسواق وندرتها، وهو ما دفع بالمشرع الجزائري إلى استحداث قانون خاص بمكافحة المضاربة غير المشروعة وهو القانون رقم 21/15. وتقوم جريمة المضاربة غير المشروعة كغيرها من الجرائم الأخرى على ثلاثة أركان، الركن الشرعي والركن المعنوي والركن المادي، وهذا الأخير طرح إشكالات عديدة بخصوص تصنيف جريمة المضاربة غير المشروعة من بين الجرائم المادية أو الجرائم المعنوية. وتوصلت الدراسة إلى أن جريمة المضاربة لا يمكن أن تقوم على ركن مادي فقط، بل يتطلب كذلك ركن نفسي معنوي يجسد الدافع الجنائي العام والخاص لارتكاب الجريمة، و تحقيق أغراض ربحية من وراءها. Abstract: The crime of illegal speculation is one of the practices that has become distressing to the consumer and threatens the security and stability of society, especially in light of the outbreak of the covid-19 pandemic, where the Algerian citizen was surprised every time by the disappearance of some goods from the markets and their scarcity, which prompted the Algerian legislator to introduce a special law to combat illegal speculation, Law No. 21/15. The crime of illegal speculation, like other crimes, is based on three pillars, the legitimate pillar, the moral pillar and the material pillar, and the latter has raised many problems regarding the classification of the crime of illegal speculation among material crimes or moral crimes. The study concluded that the crime of speculation can not only be based on a material pillar, but also requires a psychological and moral pillar that embodies the public and private criminal motive to commit the crime, and the achievement of profitable purposes behind it.
