العقوبة في جريمة المضاربة غير المشروعة بين التشديد والتخفيف Punishment For The Crime Of Illegal Speculation Between Stress And Relaxation

Résumé: ملخص: في أعقاب ندرة شهدتها البلاد في سلع ومنتجات كثيرة؛ لاسيما منها تلك التي تعرف دعما بمبالغ ضخمة من خزينة الدولة، ألغى المشرع الجزائري المواد 172، 173، 174 المجرمة للمضاربة غير المشروعة في قانون العقوبات؛ وأقرّ قانونا خاصا بمكافحة المضاربة غير المشروعة هو القانون 21-15 المؤرخ في 28 ديسمبر 2021. وفي هذا النص الجديد أقرّ المشرع الجزائري عقوبات أصلية وأخرى تكميلية؛ وحدد حالات التشديد؛ ومدى إمكانية التخفيف. الأمر الذي دعانا لأن نتطرق من خلال هذه المداخلة للعقوبة في جريمة المضاربة غير المشروعة ومدى تحقيقها للوظائف العامة للعقوبة. Abstract: In the wake of the country's scarcity of many commodities and products; Especially those that are known to support huge sums of money from the state treasury. The Algerian legislator abolished Articles 172, 173, and 174 criminalizing illegal speculation in the Penal Code. And he approved a law to combat illegal speculation, which is Law 15-21 of December 28, 2021. In this new text, the Algerian legislator approved original and complementary penalties. and identify cases of stress; and the possibility of mitigation. Which prompted us to address, through this intervention, the penalty in the crime of illegal speculation and the extent to which it achieves the general functions of the penalty.
