مبدأ الأمن القانوني في التعديل الدستوري لسنة 2020

Résumé: تضمن التعديل الدستوري لسنة 2020 النص بشكل صريح على مبدأ الأمن القانوني، وذلك من خلال نص المادة 34 من التعديل الدستوري، إذ نلاحظ من خلالها ربط المؤسس الدستوري لمبدأ الأمن القانوني بالحقوق الأساسية والحريات العامة، وجعله كضمانة من بين الضمانات المتعددة لحماية الحقوق الأساسية والحريات العامة، هذه الحقوق والحريات لا تقبل التقييد إلا للضرورات، وبضمانات حددتها المادة 34 من التعديل الدستوري المذكور. كما أن المؤسس الدستوري الجزائري من خلال المادة المذكورة أعلاه حدد أهم مقومات وعناصر الأمن القانوني، المتمثلة في ضمان الوصول إلى القانون ووضوحه واستقراره. The constitutional amendment of 2020 explicitly included the text of the principle of legal security through the text of Article 34 of the amendment, as we note that the constitutional founder linked the principle of legal security to basic rights and public freedoms, and made it as a guarantee among the many guarantees for the protection of basic rights and public freedoms, these rights and freedoms are not accepted Restriction except for necessities and with guarantees specified in Article 34 of the said constitutional amendment. Also, the Algerian constitutional founder, through the above-mentioned article, defined the components and elements of legal security represented in ensuring access to the law, its clarity and stability.
