الحرب على الإرهاب في القانون الدولي

Résumé: ملخص: لا يختلف اثنان على أن هذه الظاهرة لا يمكن أن تبررها أية اعتبارات سياسية أو فلسفية أو دينية،كما يجب مكافحتها في إطار من التعاون بين أعضاء المجتمع الدولي،و ألا يترك أمر مكافحتها لدولة بعينها،على أن تتم إجراءات مكافحتها في إطار الاحترام الكامل لقواعد القانون الدولي العام. و نظرا لأهمية هذا الموضوع، ترمي هذه الورقة البحثية للنظر في مدى مشروعية الحرب المعلنة ضد الإرهاب في القانون الدولي؟ و مدى اعتمادها على الأسس القانونية بدل ارتكازها على الأهداف و المصالح السياسية المتضاربة و الضيقة. و سيتم ذلك من خلال البحث في المستندات القانونية للحرب ضد الإرهاب في الفقه المعاصر،و الوقوف على موقف القانون الدولي العام من استخدام القوة في مواجهة الدول الراعية للإرهاب،سيما في ظل ما يعرف بالحرب الإستباقية.
