علاقة رئيس الجمهورية بالحكومة في ظل التعديل الدستوري 2020

Résumé: • ملخص: يطرح التقسيم الذي اعتمده المؤسس الدستوري الجزائري للسلطات العامة تحت عنوان تنظيم السلطات والفصل بينها، العديد من التساؤلات من بينها علاقة رئيس الجمهورية بالحكومة بعد استغنائه عن التقسيم الثلاثي للسلطات العامة في الدولة، والتي كان فيها رئيس الجمهورية والحكومة يشكلان قطبي السلطة التنفيذية. والتقسيم الجديد المعتمد دفع المؤسس الدستوري إلى الحديث مرة عن الوزير الأول، واخرى عن رئيس الحكومة، تسميتان لمنصب واحد وهو قيادة الحكومة، مع امكانية وجود نوع من التغييرات التي تطرأ على العلاقة مع رئيس الجمهورية من جهة، ومع البرلمان من جهة ثانية، مما يبرز لنا في كل مرة ملمح من ملامح توجه النظام الدستوري في الجزائر. • Abstract: The division adopted by the Algerian constitutional founder concerning public authorities, under the title of organizing and separating powers, raises many questions including the relationship of the President of the Republic with the government after having renounced the tripartite division of public powers in the State, in which the President of the Republic and the Government constituted the two poles of the executive power. And the new approved division prompted the constitutional founder to nickname once the Prime Minister, and another the Head of Government, two names for one position, which is the leadership of the government, with the possibility of some kind of changes that may occur in the relationship with the President of the Republic on the one hand, and with Parliament on the other, which highlights to us each time a feature of the orientation of the constitutional regime in Algeria.
