Résumé: الملخص: تعد أركان الشرعية الإجرائية من المبادئ الدستورية المسلم بها في الدول الديمقراطية وتكفلها المواثيق الدولية لحقوق الإنسان، كما يكفل الدستور- بحكم كونه الوثيقة العليا الملزمة للمشرع – تحقيق هذه الشرعية، والواقع أنه كلما كان الدستور صادقا في تعبيره ملبيا لآمال الشعب وتطلعاته كانت الشرعية الدستورية قائمة على أساس سياسي متين، وبالتالي فالشرعية الدستورية وحدها هي التي تتمتع بالقيمة الإلزامية للمشرع خاصة في المادة الجنائية، وعليه فالدستور أداة هذه الشرعية وهو الذي يرسم أطرها وأسسها ويلزم المشرع بإتباعها عند وضع قواعد الإجراءات الجنائية، وكنتيجة لذلك فهو أيضا ملزم عند صياغته للقاعدة التشريعية بكفالة الحقوق والحريات العامة. Abstract: The pillars of procedural legitimacy are recognized constitutional principles in democratic states and guaranteed by international human rights conventions, and the Constitution, by virtue of being the supreme binding document of the legislator, guarantees the realization of this legitimacy. In fact, whenever the Constitution is true in its expression, it meets the people's hopes and aspirations, the constitutional legitimacy is based on a solid political basis, and therefore only constitutional legitimacy enjoys the mandatory value of the legislator, especially in the criminal article, and therefore the Constitution is the instrument of this legitimacy, which draws its frameworks and foundations and obliges the legislator to By following them when establishing criminal procedure rules, as a result, he is also obliged when drafting the legislative rule to guarantee the public rights and freedoms.
