الشرعية الجنائية الإجرائية: نجاعة الصياغة وفعالية التطبيق

Résumé: يعبر مبدأ الشرعية الجنائية الإجرائية عن واحد من أهم مرتكزات المحاكمة العادلة وعن وجه من أوجه العدالة الجنائية، والذي يقتضي أن تخضع جل إجراءات المتابعة الجزائية - بمختلف أطوارها ومراحلها - لقانون الإجراءات الجزائية، وفق ما تقتضيه الهندسة الدستورية، والصياغة القانونية السامية، التي عنت بهذا المبدأ، ورسمت معالمه ووضعت مقوماته، ليطرح هذا العمل ويناقش مسألة جوهرية تتعلق بالمكانة التشريعية لمبدأ شرعية الإجراءات الجزائية، وبعده العملي في الميدان القضائي، في المرحلة الإجرائية التي يتاخم المبدأ سلطات القاضي بتطبيق النصوص الإجرائية، وصلاحياته التي تطرأ على هذا التطبيق؛ مستهدفا ووفق إطار منهجي ضبط المعالم التشريعية والقضائية لحلقة الشرعية الإجرائية في المادة الجزائية؛ وكل ذلك في ضوء التوجهات التشريعية الوطنية بعد التعديل الذي لحق قانون الإجراءات الجزائية بموجب القانون 17 – 07 المؤرخ في: 17 مارس 2017.
