النظام القانوني للاستثمار الجزائرى بالخارج The Legal System For Algerian Investment Abroad

Résumé: كرًس المشرع الجزائري حرية الاستثمار بالنسبة للمتعاملين الاقتصاديين الجزائريين الراغبين في التوسع في الخارج ،و ذلك من خلال النظام 14/04 الصادر عن بنك الجزائر. تهدف هذه الدراسة لتحليل النصوص القانونية المنظمة للاستثمار الجزائري بالخارج، و الوقوف على ايجابيات الإطار القانوني، و لكن ايضا الوقوف على العوائق، و القيود التى تعيق المستثمر الجزائري للتوسع و الاستثمار في الخارج. من خلال تحليل النظام 14/04 يتبين انه يتميز بالصرامة و التقييد ، ،و بالتالي تظهر الحاجة الملحة لتعديله ،و اضفاء المزيد من المرونة عليه، للتوصل لتطوير و تشجيع الاستثمارات الجزائرية بالخارج . The Algerian legislator has established the freedom of investment to Algerian economic operators wishing to expand abroad, through the regulation 04/14 of the Bank of Algeria. The purpose of this study is to analyze regulation 14/04 and to identify the advantages legal framwork but also the obstacles and constraints that impede Algerians investors to expand to abroad. Through the analysis of the regulation14/04 it becomes evident that it is characterized by strictness and restriction , and thus the urgent need to amend , and to give more flexibility to it ,to rich the development and encouragement of Algerian investments abroad.
